Agar Shohar mazak mey ho yah gusse mey apni biwi se yeh kehde ki "ja mai tuhe azaad kar diya" is tarah k alfaaz kehne par kya talaq hojati hai? jab k kehne wale ko is cheez ka ilm nhi hai ...

Ek fatwa pesh kar raha hun. Us mein aapka jawaab hai:

Shauhar ka biwi ko “Main ne tujhe aazad kiya” jaise alfaaz kehna

Assalamu Alaikum Warehmatullahi Wabarakatuhu

Sawaal:
Agar shauhar apni biwi ko kahe ke “Main ne tujhe aazaad kiya” to is tarah talaq ho jaayegi?

Jawaab:
Walaikum Assalam Warehmatullahi Wabarakatuhu!
الحمد لله، والصلاة والسلام علىٰ رسول الله، أما بعد​
Allah ﷻ ke nazdeek nikah ka rishta is qadar hassaas aur mazboot hai ke use ishaaron aur kinaayon se nahi toda jaa sakta hai. Use khatm karne ke liye saraahat ke saath lafz-e-talaq iste’maal karna padta hai ya phir siyaaq-o-sabaaq ka khayaal karte huwe niyyat ko dekhna chaahiye. Soorat-e-mas’oola (sawaal mein poochi gayi soorat) mein shauhar ka apni biwi ko yun kehna ki “Main ne tujhe aazaad kiya” rishta-e-izdiwaaj (shadi ke rishte) ko khatm karne ke liye sareeh aur wazeh nahi hai, haan, agar siyaaq-o-sabaaq ke pesh nazar in alfaaz se shauhar ki niyyat apni biwi ko talaq dene ki thi to in alfaaz se talaaq ho jaayegi, jaisa ke Rasoolullah ﷺ ne apni ek mankooha ko talaaq dene ke liye yeh alfaaz iste’maal kiye ke “Tu apne ghar chali jaa.” (Sahih Bukhari: 5254)

Choonki Rasoolullah ﷺ ki niyyat talaaq dene ki thi, is liye siyaaq-o-sabaaq ke pesh nazar yeh alfaaz talaq ke liye kaafi the. Lekin jab yahi alfaaz Hazrat Ka’ab bin Malik Radhiallahu Anhu ne apni biwi ke liye iste’maal kiye ki: “Tu apne ghar chali jaa.” (Sahih Bukhari: 4418) To un alfaaz se talaq waaqe’ nahi hue kiunki Hazrat Ka’ab bin Malik Radhiallahu Anhu ki niyyat talaaq ki na thi. Imam Bukhari Rahimahullah ne apni Sahih main ek baab in alfaaz ke saath qaayim kiya hai “Jab shauhar apni biwi se kahe ke main ne tujh ko alag ya aazaad kiya ya koi lafz jis se talaq ka mafhoom liya jaa sakta ho to mu’aamla us ki niyyat par mehmool hoga.” (Sahih Bukhari, Kitaab-ut-Talaq)

In haqaaiq ke pesh nazar soorat-e-mas’oola (sawaal mein poochi gayi soorat) mein agar in alfaaz se shauhar ki niyyat talaq dene ki thi to talaq waaqe’ ho jaayegi. Warna (talaq ki niyyat nahi thi to) talaq nahi hogi, taaham shauhar ko chaahiye ke agar apni biwi ko talaq nahi dena chaahta to is tarah ke zo ma’ne (do ma’ani waale) alfaaz iste’maal karne se bhi bacha kare, kiunki mu’aasharati taur par aise alfaaz se mushkilaat paida ho sakti hain.
