KHULA’ KI TAAREEF AUR USKA TARIKA

Biwi mua’wiza de kar alahda (alag) ho to usey Khula kaha jata hai. Is tarah khawind mua’wiza lekar apni biwi ko chorde chahe wo ye maher jo ki khawind ne dia tha wo ho ya isse zyada aur ya fir kam ho.

Iski daleel Allah subhanahu wa ta’alaa ka farmaan hai:
Aur tumhare liye halal nahi ke tum ne jo kuch unhe dia hai us me se kuch wapas le loo magar ye ke wo dono isse khaufzada hon ke wo Allah ta’ala ki hudood ko qa’im nahi rakh sakenge, to phir un par koi gunah aur jurm nahi ke wo iska fidya dee.

Surah Baqara, ayat-299

Sunnat e Nabawi ѕαℓℓαℓℓαнυ αℓαyнє ωαѕαℓℓαм me iski daleel Sabit bin Qays Radhiallahu Anhu ki biwi ki hadees hai:
Sabit bin Qays Radhiallahu Anhu ki biwi Nabi ѕαℓℓαℓℓαнυ αℓαyнє ωαѕαℓℓαм ke paas aayi aur kahne lagi, “Aye Allah ke Rasool ѕαℓℓαℓℓαнυ αℓαyнє ωαѕαℓℓαм main Sabit ibn Qays par koi deeni ya aqhlaqi a’ib nahi lagati, lekin main Musalman hone ke baad koi kufr nahi karni chahti. To Nabi ѕαℓℓαℓℓαнυ αℓαyнє ωαѕαℓℓαм ne usey farmaya ke Kya tum inka Baagh wapis karogi? (Kyuki Ye Baagh Sabit bin Qays Radhiallahu Anhu ne usey maher me diya tha) to wo kehne lagi “Ji haan”.
Toh Nabi ѕαℓℓαℓℓαнυ αℓαyнє ωαѕαℓℓαм ne (Sabit bin Qays Radhiallahu Anhu se) farmaya: Apna Baagh Qabool karlo aur ise chhordo.

Sahih al Bukhari, hadith- 5273

Ulama e kiraam ne is qisse se ye istembaat kiya hai ke jab aurat apne khawind ke sath rahne ki taqat na rakhe to Wali ul Amr (ikhtiyaar waale) aur hukmaran (judge) uske khawind se khula talab karen balke usey khula ka hukm den.


KHULA KI SURAT YE HAI KE
Khawind ke iwaz me kuch le ya fir wo kisi iwaz par muttafiq ho jaye aur fir khawind apni biwi ko kahe ke main ne tujhe chordiya ya khula kar liya is tarah ke dusre alfaaz kahe.

Aur talaq Khawind ka haq hai ye is waqt tak waq’e nahi ho sakti jab tak wo talaq na de, isliye ke Nabi ѕαℓℓαℓℓαнυ αℓαyнє ωαѕαℓℓαм ka farmaan hai, “Talaq uska haq hai jo pindli ko pakadta hai”, (Ya’ani khawind).

Sunan ibn Majah, Hadith-2081
Allama Albani r.h. ne Irwa’ al-Ghaleel me ise hasan qaraar dia hai,2041.

Is liye Ulema e karam ne ye kaha hai ke: Jise apni biwi ko talaq dene par zulm ke sath majboor kiya jaye aur isne talaq de di to iski ye talaq waq’e nahi hogi, Dekhe al-Mughni- 10/352.

Aur Aap ne jo ye zikr kia hai ke ba’az auqaat biwi hukumati qawaneen ke mutabiq apne ap ko talaq de de, to iske baare me hum kahenge ke: Agar ye kisi aise sabab ki bina par hai jiski bina par talaq mubah ho jati hai, Masalan agar wo khawind ko na pasand karne lage aur uske sath zindagi na guzaar sake ya fir khawind ke fisq wa fujoor aur haram kaam karne ki jur’at karne ki bina par usey Deeni ai’tbaar se na pasand karne lage wagairah, To usey Talaq ka mutalba karne me koi harj nahi.
Lekin aisi halat me wo khawind se khula karle aur uska diya hua maher wapis karde.

Aur agar wo talaq ka mutalba kisi sabab ke bagair kare to aisa karna uske liye jayez nahi aur is halat me adaalat ka talaq ke mutalliq faisla sharayi nahi hoga balke aurat badasutoor us admi ki biwi hi rahegi.

To yahan par ek mushkil pesh aati hai ke qanooni taur par to ye aurat mutlliqa (divorcee) shumaar hogi aur id’dat guzarne ke baad kahin aur shadi karlegi lekin haqeeqat me biwi ko talaq hui hi nahi.

Shaykh Muhammad ibn Saalih al-‘Uthaymeen Rahimahullah ne is jaise masle me kuch is tarah kaha hai: “Ab hamare samne ek mushkil hai, uski zaujiyat aur ismat me rahte hue kahin aur shadi karna uske liye haram hai aur zahiri taur par adaalat ke hukm ke mutabiq use talaq ho chuki hai aur jab iddat khatam ho jaye to kahi aur shadi kar sakti hai.
To meri raaye ye hai ki is mushkil se nikalne ke liye zaroori hai ke ahl e khair aur islaah karne wale loog zaroor is masle me dakhal den taa’ke khawind aur biwi ke darmiyaan sulah ho sake, warna wo aurat apne khawind ko i’waz adaa karde ta’ake sharai taur par khula ho sake.
