Aqeeqah Aq عق Se Mushtaq Hai Jis Ka Lugwi Ma'ni Phaarne Ke Hai Aur Sharai Istilaah Me Us Jaanwar Ko Kaha Jata Hai Jo Nawmaulood Ki Paidaish Par 7twe Din Is Ne'mat Ke Izhaar Ke Taur Par Zabaah Kiya Jaae. Aqeeqah Behtar Naam Naseeka Ya Zabeeha Hai. Yaha Yah Baat Bhi Jaan Le Ke Aqeeqah Karna Dalaail Ki Roshni Me Sunnat E Muakkidah Hai.
Nabi Sallallahu Alyhi Wasallam Ka Farmaan Hai:
من ولد له ولد فاحب ان ينسك عنه فلينسك.(صحيح ابي داؤد: 2842)
Tarjumah: Jis Ke Yaha Bachche Ki Wilaadat Ho Aur Woh Uski Taraf Se Qurbaani(Aqeeqah) Karna Chahta Ho To Kare.
Aqeeqah Chhote Jaanwar Yani Bakra/Bakri Aur Bhed Aur Dunba Se Dena Chaahiye, Bade Jaanwar Me Aqeeqah Dene Se Bachna Chaahiye Magar Yah Ke Majboori Ho. Hadees Me Aqeeqah Ke Liye Sha'atun Ka Lafz Aaya Hai Jo Bhed Aur Bakri Dono Par Itlaaq Kiya Jata Hai.
Ibne Hazam Ne Likha Hai:
واسم الشاة يقع الضائنة والماعز بلا خوف.(المحلي 6/234)
Tarjumah: Aur Sha'atun Ka Lafz Bhed Aur Bakri Dono Par Bila Ikhtilaaf Itlaaq Hota Hai.
Baaz Ahle Ilm Bade Jaanwar Me Bhi Aqeeqah Ke Qaail Hai. Behar Haal Amar Waas'e Hai Jise Me Is Tarah Bayaan Karna Chahata Hu Ke Pehle Chhote Jaanwar Me Aqeeqah Karne Ki Koshish Kare Agar Yah Mumkin Na Ho Sake To Majburi Me Bade Jaanwar Me Aqeeqah De Sakte Hai Magar Waazeh Rahe Aqeeqah Me Mukammal Jaanwar Zabaah Karna Hai Kuy Ke Khoon Bahane Ka Hukm Hai Aur Isme Ishtiraak Jaiz Nahi Hai. Rasool Sallallahu Alyhi Wasallam Ne Farmaya:
مع الغلام عقيقة فاهريقوا عنه دما واميطوا عنه الاذى.(صحيح الترمذي:1515)
Tarjumah: Ladke Ki Paidaish Par Aqeeqah Hai Lihaza Jaanwar Zabaah Kar Ke Uski Taraf Se Khoon Bahaao Aur Uski Gandagi Door Karo.
Aksar Musalmaano Ke Yaha Eid e Qubaan Ke Mauqah Par Ek Bade Jaanwar Me Qurbaani Ke Sath Bachche Ka Aqeeqah Bhi Hissa Liya Jata Hai Jo Ke Sunnat Ki Khuli Mukhalifat Hai. Agar Taaqat Hai To Bachcha Ki Taraf Se Mustaqeel Jaanwar Ka Aqeeqah De Aysa Karne Se Sunnat Puri Hogi Aur Taaqat Na Ho To Na De Is Par Allah Pakad Nahi Kare Ga.
Aqeeqah Ke Jaanwar Ki Umar Ke Silsile Me Basarahat Kuch Manqool Nahi Hai Is Liye Kuch Ulama Ne Kaha Ke Kisi Bhi Umar Ka Jaanwar Aqeeqah Kiya Ja Sakta Hai Chaahe 3 Maah Ho,5 Month Ka Ho Magar Yah Qawi Qaul Nahi Maloom Hota Hai Kuy Ke Umooman Log Ayse Jaanwar Ko Zabaah Karte Hai Jo Kam Az Kam Zabaah Karne Aur Khane Ke Laiq Ho,Ayse Me 1 Year Bakari Hi Munaasib Maloom Hoti Hai Aur Upar Guzar Chuki Abu Dawood Ki Hadees Me Nask Ka Lafz Aaya Hai Jo Hadi(Haj Ka Jaanwar) Ke Liye Istimaal Hota Hai, Goya Aqeeqah Bhi Hadi Ke Qaaim Maqaam Hai Aur Is Baabat Imaam Maalik RH Ka Qaul Bhi Jo Aage Aa Raha Hai Is Liye Isme Bhi Hadi Ke Sharaait Baja Laani Chaahiye.
Imaam Ahmad Bin Hambal RH Ne Abu Dawood Ki Is Hadees Se Istidlaal Karte Hue Kaha Hai Ke Isme Daleel Hai Ke Aqeeqah Me Wahi Kifaayat Karega Jo Nask/نسك Me Kifaayat Karta Hai Chaahe Azhiya (Eid Ki Qurbani) Ho Ya Hadi(Haj Ki Qurbani). Aage Likhte Hai Ke Isme Is Umar Ka Atebaar Kiya Gaya Hai Jo Qurbaani Aur Aqeeqah Me Kifaayat Karta Hai Aur Mukammal Wasf Mashro'o Ki Gai Jo Dono Barabar Ho, Un Me Se Kisi Me Kami Na Hoto Yaha Saal Ka Atebaar Kiya Gaya Hai Jo Zabaah Ke Liye Ma'moor Ba Saal Hai (Tohfatul Mawdood:63)
Is Silsile Me Jamhoor Ka Yahi Mauqah Hai Ke Aqeeqah Me Qurbaani Ki Sharaait Malhooz Rakhe Jaae Goke Baaz Masaail Me Aqeeqah Aur Qurbani Mukhtlif Bhi Hai Masalan Qurbaani Me Ishtiraak Jaiz Hai. Jabke Aqeeqah Me Nahi Hai.
Niche Ahle Ilm Ke Kuch Aqwaal Zikr Kiye Jate Hai Jo Aqeeqah Ko Qurbaani Ke Hukm Me Maante Hai Jis Ka Matlab Yah Hai Ke Aqeeqah Ke Jaanwar Me Bakri Ke Liye Ek Saal Ki Umr Chaahiye.
(1) Ibne Qudaamah Likhte Hai:
ويجتنب فيها من العيب ما يجتنب في الضحية وجملته ان حكم العقيقة حكم الضحية في سنها وانه يمنع فيها من العيب ما يمنع فيها.(المغني:7/366)
Tarjumah: Aur Aqeeqah Me Is Aib Se Ijtinaab Kiya Jaaega Jis Se Qurbaani Me Ijtinaab Karte Hai Aur Minjumla Aqeeqah Ka Hukm Umr Me Qurbani Ka Hi Hukm Hai Aur Isme Ayse Aib Se Bhi Man'a Kiya Jaae Ga Jo Qurbaani Me Mamno'o Hai.
(2) Imaam Maalik RH Ne Kaha:
وانما هي اي العقيقة بمنزلة النسك والضحايا.(الموطا: 2/400)
Tarjumah: Aur Aqeeqah Hadi Aur Qurbani Ke Darje Me Hai.
(3) Aur Imaam Nawwi RH Ne Bhi Isi Taraf Isharah Kiya Hai.(Almugni:9/436)
(4) Imaam Tirmizi Ne Ulama Ka Qaul Naqal Karte Hue Likha Hai:
لا يجزى في العقيقة من الشاة ما يجزى فى الاصحية.(جامع الترمذي:4/86)
Tarjumah: Bakri Ke Aqeeqah Me Wahi Kifaayat Karega Jo Qurbani Me Kifaayat Karta Hai.
(5) Ibnul Haaj Maaliki Kehte Hai:
وحكمها حكم الاضحية في السن والسلامة من العيوب.(المدخل 3/277)
Tarjumah: Aur Aqeeqah Ka Hukm Umr Ke Silsile Me Aur Uyoob Se Paak Hone Ke Silsile Me Qurbani Ke Hukm Ki Tarah Hai.
(6) Ibne Habeebul Maalki Kehte Hai:
سنها واجتناب عيوبها ومنع بيع شئ منها مثل الاضحية الحكم واحد(التاج والاكليل:4/390)
Tarjumah: Aqeeqah Ki Umr Aur Uska Aib Se Paak Hona Aur Usme Se Kuch Bechna Qurbaani Ki Tarah Hai,Hukm Ek Hi Hai.
(7) Arab Ke Ulma Masalan Shaikh Ibne Usaimeen, Shaikh Muhammad Saaleh Munajjad, Abdur Rahman Bin Naasir Albaraak,Shaikh Saaleh Fauzaan, Shaikh Bakr Abu Zaid, Shaikh Abdullah Bin Gadyaan Aur Shaikh Abdul Azeez Bin Abdullah Aale Shaikh Wagairah Ki Yahi Raae Hai. Yahi Wajah Hai Ke Jamhoor Fuqha Ka Qual Hai Ke Aqeeqah Me Un Aibo Se Bachaa Jaae Ga Jin Se Qurbani Me Bacha Jata Hai. (Alistizkaar 15/384)
Mazkoorah Bala Lines Ki Roshni Me Khulasa Ke Taur Par Yah Kaha Jaae Ga Ke Aqeeqah Ke Jaanwar Ki Umr Ke Bare Me Sareeh Daleel Maujood Nahi Hai Taaham Aqeeqah Se Mutalliq Nusoos Aur Mazkoorah Bala Aqwaal Ahle Ilm Ki Roshni Me Maloom Hota Hai Ke Aqeeqah Me Jaanwar Ki Sharaait Ko Laazim Qaraar Nahi Diya Jaaega Magar Ahtiyaat Ke Taur Par Qurbani Ke Sharaait Ko Aqeeqah Me Malhooz Rakha Jaae Ga Kuy Ke Hadees Me Waarid Lafz Sha'atun Ka Itlaaq Bachcha Dene Wali Bakri Par Hota Hai, Nask Se Haj Ki Qurbaani Ka Hukm Nikalta Hai, Kabash Ka Lafz Bhi Waarid Hai Is Se Jawaan Mendha Muraad Hota Hai Aur شاتان مكافئتان Se Be-Aib Aur Motabar Umr Ki Taraf Isharah Hai. Haa Qurbani Ki Taraah Aqeeqah Me Sharaait Malhooz Rakhna Mushkil Ho To Saal Se Kam Bakri Ya Bila Zarar Aib Wala Jaanwar Aqeeqah Kar Sakte Hai.
Yaha Yah Baat Batlana Bhi Munaasib Ma'loom Hota Hai Ke Aqeeqah Me Bahut Wus'at Hai Is Liye Wus'at Me Ziyadah Sakhti Karna Thik Nahi Hai, Mundarja Zail Lines Me Wus'at Se Mutalliq Chand Masaail Bayaan Kiye Jaate Hai.
(1) Agar Chhota Jaanwar Na Mile Ya Us Se Aajiz Ho To Bade Jaanwar Me Bhi Aqeeqah Kar Sakte Hai Albatta Qurbaani Ki Tarah Mushaarikat Jaiz Nahi Hai.
(2) Qurbaani Ki Tarah Sharaait Pure Na Kar Sakte Ho To Jis Umr Ka Jaanwar Aqeeqah Karna Maiyssar Ho Kar Sakte Hai.
(3) Agar Saatwe Din Maiyssar Na Ho To Baad Me Bhi Aqeeqah De Sakte Hai Yaha Tak Ke Badi Umr Me Bhi.
(4) Bagair Aqeeqah Ke Koi Bachcha Wafaat Paa Gaya Ya Kisi Ayse Shakhas Ka Intiqaal Ho Gaya Jis Ka Aqeeqah Nahi Hua Tha To Uski Taraf Se Wafaat Ke Baad Bhi Aqeeqah De Sakte Hai, Faut Shuda Bachcha Ki Taraf Se Aqeeqah Ke Liye Zaroori Hai Ke Woh Saatwe Din Ke Baad Intiqaal Kiya Ho.
(5) Ladka Ki Taraf Se 2 Jaanwar Aqeeqah Karna Hai Magar Bar Waqt Sirf Ek Jaanwar Aqeeqah Karne Ki Taaqat Ho To Ek Bhi De Sakte Hai Aur Ek Dusra Baad Me Taaqat Hone Par Aqeeqah Kare.
(6) Agar Kisi Ko Yah Maloom Ho Ke Uska Aqeeqah Nahi Hua Hai To Khud Apna Aqeeqah Bhi Kar Sakte Hai.
(7) Agar Koi Ayse Aibo Se Paak Jaanwar Ka Aqeeqah Karne Se Aajiz Ho Jin Ka Qurbaani Me Atibaar Kiya Jata Hai To Fir Aibdaar Ka Aqeeqah Bhi Kar Sakte Hai Bashart Yah Ke Aysa Aib Na Ho Jo Nuqsaan Pohnchaane Wala Ho.
